Procedures for Filing a Complaint

 

Initiation Under an Agreement to seek remedy via NACHI ADRS

 

The filing party must verify that the other party is a current subscriber to NACHI ADRS.  An on-line complaint registration should be filled out completely.

        The demand should:

▪ briefly explain the dispute,

list the names and addresses of the consumer and
  the business,

specify the amount of money involved,

state what the claimant wants.

The claimant must complete the on-line Complaint Form.  The claimant must also submit a copy of the arbitration agreement from the consumer contract with the business. There is a fee of $300 to file a complaint with NACHI ADRS which can be paid at the time the complaint is filed.

Additional fees my be applied for copying, shipping/mailing, conference calls, telephone calls, other legal fees, notifications and other related administrative services.

The Claim in Arbitration

a.   The Claimant shall initiate the arbitration by submitting to NACHI ADRS a complaint. Said complaint can be electronically filed via the on-line complaint form link on this site, or via fax transmittal to NACHI-ADRS. The claim (the "Claim"), shall include: the agreement between the parties; a statement regarding the nature of the dispute, the legal arguments which support the Claim, the amount involved, if any, and the remedy sought.

b.   The Claimant shall pay the appropriate filing fee at the time of Claim submission

c.   Upon receipt of the Claim an payment, NACHI ADRS shall review the submissions, and begin the notification process to all parties that a claim has been filed, and action sought.

d.   A record is generated, and Agreements may be sent to the parties, which must be executed and returned to ADRS prior to further action.

e.   Electronic packages may be sent to the parties, requesting case-specific information, including details supporting or disputing the claims made.

f.    Follow-up correspondence may be requested.

g.   Timelines to resolution are kept deliberately short. Target dates for settlement or decision are typically set at 60-days, maximum.

h.   Information requested shall include copies of the actual inspection report. If the State or Municipality where the inspection took place requires prior written consent of the parties, prior to release of the inspection report, said authorization is expected at the time of document submission.
